Although
there is no definite date when the Government's
new laws on corporate
manslaughter will arrive on the Statute Book,
it seems that this is, in any case, just a formality.
Directors of businesses, large or small, and sole
proprietors are already more accountable for deaths
caused to employees and the public through
management negligence.
One particularly vulnerable area is employees
who drive as part of their working day, such as
delivery drivers, sales reps, couriers and so
on.
Russell Hill of Chiltern Driver Training, says:
"People have got a duty of care and
anybody driving a company car is under an obligation
to the employer. Likewise, the employer is under
an obligation to employee to ensure that the car
is in good
condition and that the driver is competent.
"How many people jump into a pool car without
checking its roadworthiness - such as tyre pressure,
brake lights, head lights and so on. Or if its
tax and insurance are up to date."
Talking to the Gerrards Cross Cross Reference
networking group of local businesses, Russell
also pointed out that few drivers are aware, for
instance, that it is illegal not to have a proprietary
screen wash in a windscreen washer reservoir -
water alone simply will not do!
He explained: "The Management of Work Act
(1992) already requires an employer to carry out
'suitable and sufficient' assessments of employees
to examine what
'reasonable and practicable' steps can be taken
to reduce risks. Further legislation will tighten
things up even further."
Risk assessment through driver training was one
important way an employer could reduce risk and
vulnerability to corporate manslaughter. But,
Russell Hill, explained, it was not a once only
solution, "risk assessment is an ongoing
evaluation that should continue throughout the
working life of every appropriate employee for
his/her own safety and that of the public.
